PAID BETA SERVICE NOTICE: Ossia is currently in paid beta. By using this service, you acknowledge and accept the beta limitations described in Section 3 below. Payment for access to Ossia does not alter or waive any beta limitations.
1. Agreement to Terms
Ossia is a product of Bobenhouse Industries, LLC ("Ossia," "Bobenhouse," "we," "our," or "us"). By accessing or using the Ossia platform and services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our services.
Ossia is intended for business and professional use only.
2. Description of Services
Ossia provides competitive intelligence services in the following categories:
Research Reports. One-time deliverables including industry landscape reports and custom competitive deep dives for a single product or market. Reports are static documents delivered upon completion and are not updated after delivery unless separately agreed upon in writing.
Platform Access. Ongoing subscription access to Ossia's suite of competitive intelligence applications, including competitor research, knowledge base, survey tools, team collaboration, and secure sharing portals. Platform features and availability may change during the beta period.
Premium Services. Subscription access to the full platform combined with dedicated research analyst support, custom market analysis, and prototyping services. The scope of premium services will be defined at the time of purchase or in a separate statement of work.
3. Beta Service Limitations
IMPORTANT: These limitations apply to all service tiers, including paid subscriptions and one-time report purchases.
3.1 Data Quality and Accuracy
Ossia is designed to accelerate and structure competitive research as part of your team's workflow, not to replace independent professional judgment. While we work continuously to improve the quality and reliability of the platform, you acknowledge that:
- AI-generated outputs may contain errors, inaccuracies, omissions, or outdated information
- All outputs should be reviewed and verified by qualified professionals before use
- Output quality may vary based on the specificity of inputs, data availability, and the maturity of the underlying models
- Investment decisions or financial planning
- Safety assessments or risk evaluations
- Healthcare or medical decisions
- Legal decisions or compliance determinations
- Regulatory filings or submissions
- Personnel, hiring, or employment decisions
- Any decision with significant financial, legal, health, or safety consequences
Nothing in these services creates a fiduciary, advisory, or professional services relationship between Ossia and its users.
3.2 Data Persistence
While we take reasonable measures to protect your data, Ossia's infrastructure is still maturing and we cannot yet provide enterprise-grade data durability guarantees. You acknowledge that:
- Software bugs or technical issues may result in unintended data loss
- Platform updates and migrations may affect stored data
- We do not currently offer a guaranteed backup or disaster recovery SLA
- Features may be modified or retired over the course of the beta, which may affect data associated with those features
We will make commercially reasonable efforts to notify you in advance of any planned changes that could affect your stored data. The platform provides export functionality for major work products, and we recommend regularly exporting and maintaining your own copies of any research, reports, or other data you consider important.
3.3 No Service Level Guarantee
During the beta period, Ossia does not provide any service level agreement (SLA) or uptime guarantee. The platform may experience downtime, interruptions, or degraded performance without notice. Payment for services does not entitle you to any minimum level of availability or performance.
3.4 Limited Regulatory Assurances
Use of Ossia during the beta period does not carry any explicit guarantees regarding:
- Exclusivity of access or features
- Privacy protections beyond what is described in our Privacy Policy
- Compliance with specific industry regulations (HIPAA, SOC 2, ISO 27001, GDPR, etc.)
- Data residency or sovereignty requirements
You are responsible for determining whether Ossia is suitable for your regulatory environment.
3.5 Internal Visibility and Confidentiality
To improve and optimize the service, Ossia and its employees, contractors, and service providers may have visibility into data you submit and data generated through your use of the platform. This access is used solely for:
- Debugging and troubleshooting
- Quality assurance and testing
- Service optimization and improvement
- Feature development
We treat your business information, research inputs, and outputs as confidential. We will under no circumstances sell, license, or otherwise commercially benefit from the data you upload into the platform. Your data is yours. Our access to it exists only to make the product better for you.
3.6 Third-Party AI Services
Ossia utilizes commercial AI models from providers including Anthropic, Google, and OpenAI. While our agreements with these providers prohibit the use of your submitted data for model training purposes, you acknowledge that your data is processed by these third-party services subject to their respective terms and policies.
4. Payment and Billing
4.1 General Terms
All fees are stated in U.S. dollars unless otherwise specified. By purchasing any Ossia service, you agree to pay the fees described at the time of purchase. You are responsible for providing accurate and current payment information.
4.2 Subscription Services
Platform Access and Premium Services are billed on a recurring basis (monthly or annually, as selected at the time of purchase). Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date.
4.3 One-Time Report Purchases
Industry Reports and Custom Reports are one-time purchases. Payment is due at the time of order. Delivery timelines will be communicated at the time of purchase and may vary based on the scope of the report.
4.4 Trial Periods
We may offer discounted trial periods for subscription services at our discretion. Trial terms, including duration, pricing, and scope, will be specified at the time of the offer. At the conclusion of a trial period, your subscription will convert to the standard rate unless you cancel before the trial ends.
4.5 Cancellation
You may cancel your subscription at any time by contacting us at hello@ossia.ai or through the platform interface (where available). Cancellation takes effect at the end of your current billing period. You will retain access to subscription services through the remainder of the period you have already paid for. No partial refunds will be issued for unused time within a billing period.
4.6 Refunds
One-time report purchases are non-refundable once work has commenced on the report. If a report has not yet entered production, you may request a full refund.
Subscription services are non-refundable. Because Ossia is a beta service with the limitations described in Section 3, you acknowledge that service interruptions, data loss, or changes to features do not entitle you to a refund. In exceptional circumstances, we may issue refunds or service credits at our sole discretion.
4.7 Price Changes
We reserve the right to change our pricing at any time. For active subscriptions, price changes will take effect at the start of your next billing period. We will provide at least 30 days' notice before any price increase takes effect on your account.
4.8 Taxes
All fees are exclusive of applicable taxes. You are responsible for paying any taxes, duties, or other governmental assessments associated with your purchase, except for taxes based on Bobenhouse Industries, LLC's net income.
5. User Accounts
To access certain features, you must create an account. You agree to:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
- Accept responsibility for all activities under your account
6. Acceptable Use
You agree not to:
- Use our services for any unlawful purpose
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the integrity of our services
- Upload malicious code or content
- Scrape or collect data without permission
- Impersonate others or misrepresent your affiliation
- Use the services to harm competitors through false information
- Share, resell, or redistribute Ossia reports or platform access to third parties without written permission
- Use automated tools or scripts to access the platform in ways that exceed normal usage patterns
7. Survey Tool
Ossia includes a survey tool that allows you to create and distribute surveys to third-party respondents. When you use this feature, you act as the data controller for all respondent data collected through your surveys.
7.1 Your Responsibilities as Survey Creator
You are solely responsible for:
- Obtaining any required consent from respondents before collecting their data
- Providing respondents with clear notice about how their data will be used
- Complying with all applicable privacy laws and regulations (including CAN-SPAM, GDPR, CCPA, and any other relevant data protection laws) regarding the data you collect
- Using collected respondent data only for lawful, legitimate business purposes
- Honoring any opt-out or data deletion requests from your respondents
- Maintaining the security of respondent data after export or access
7.2 Prohibited Uses of Respondent Data
You agree not to use data collected through Ossia surveys to:
- Send unsolicited communications unrelated to the stated purpose of the survey
- Sell, rent, or share respondent contact information with third parties without respondent consent
- Harass, spam, or repeatedly contact respondents who have opted out
- Discriminate against respondents based on their survey responses
- Collect sensitive personal data (health, financial, political, or similar categories) without appropriate legal basis and respondent consent
- Mislead respondents about the purpose of data collection or your identity
7.3 Ossia's Role
Ossia acts as a data processor on your behalf for respondent data collected through surveys. We process this data solely to provide the survey functionality and do not use respondent data for our own marketing, analytics, or other independent purposes. You retain full ownership of and responsibility for all respondent data collected through your surveys.
7.4 Registered vs. Anonymous Surveys
Surveys may be configured as registered (collecting respondent name, email, company, and/or phone number) or anonymous. For registered surveys, you must ensure that respondents are informed at the point of collection about what identifying information is being gathered and how it may be used, including whether they may be contacted based on their responses.
7.5 Indemnification
You agree to indemnify, defend, and hold harmless Bobenhouse Industries, LLC, its officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your collection, use, storage, or handling of survey respondent data, including any claims by respondents or regulatory actions resulting from your failure to comply with applicable laws or the obligations described in this Section 7.
8. Intellectual Property
Our Content: The Ossia platform, including its design, features, code, algorithms, and content, is owned by Bobenhouse Industries, LLC and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from our content without explicit written permission.
Your Content: You retain ownership of data and content you provide to our platform. By using our services, you grant us a limited license to process your content solely to provide and operate the services you have requested. This license does not extend to training AI models on your data, and as stated in Section 3.5, we will under no circumstances sell, license, or otherwise commercially benefit from your data.
Report Deliverables: Upon full payment, you receive a non-exclusive, non-transferable license to use purchased reports for your internal business purposes. You may not resell, redistribute, or publicly publish Ossia reports without written permission. Ossia retains ownership of its methodologies, frameworks, and analytical approaches used in producing reports.
9. AI-Generated Content
Our platform uses artificial intelligence to generate insights, summaries, and recommendations. Part of Ossia's value is the curation and selection of AI models best suited for each function within the platform. We actively evaluate and update the models powering different capabilities to deliver the best possible results, which means the underlying models may change over time. As described in Section 3.1, Ossia is designed to work alongside your team's expertise. AI-generated content should be treated as a starting point for analysis and verified through your own professional review before informing significant decisions.
10. Disclaimers
Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We specifically disclaim any warranty that:
- The services will be uninterrupted, timely, secure, or error-free
- Results will be accurate, reliable, or complete
- The services will meet your specific requirements
- Any errors will be corrected
- Data will be preserved or remain accessible
THE BETA LIMITATIONS IN SECTION 3 CONSTITUTE MATERIAL TERMS OF THIS AGREEMENT AND ARE NOT WAIVED BY PAYMENT FOR SERVICES.
11. Limitation of Liability
To the maximum extent permitted by law, Bobenhouse Industries, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
- Your use or inability to use the services
- Any errors, inaccuracies, or omissions in generated content or reports
- Loss of data during the beta period
- Unauthorized access to your data
- Any third-party conduct on the service
- Service interruptions, downtime, or performance degradation
Our total aggregate liability for all claims arising out of or related to these terms or your use of the services shall not exceed the total amount you paid to Ossia in the twelve (12) months preceding the event giving rise to the claim.
12. Termination
We may suspend or terminate your access to our services at any time for violations of these terms or for any other reason, including discontinuation of the beta program. We will make commercially reasonable efforts to provide notice before termination, except in cases of Terms of Service violations.
You may terminate your account at any time by contacting us. For subscription services, termination is subject to the cancellation provisions in Section 4.5.
Upon termination, your right to use our services will cease immediately (or at the end of your billing period for voluntary cancellations) and your data may be deleted. For paid subscribers, we will make commercially reasonable efforts to provide a 30-day window after termination for you to export or download your data, but this is not guaranteed during the beta period.
13. Dispute Resolution and Arbitration
13.1 Informal Resolution
Before initiating any formal dispute resolution process, you agree to contact us at hello@ossia.ai and attempt to resolve the dispute informally for at least 30 days.
13.2 Binding Arbitration
Any dispute arising out of or relating to these Terms that cannot be resolved informally shall be resolved by binding arbitration administered in Cook County, Illinois, in accordance with the rules of the American Arbitration Association. The arbitrator's decision shall be final and binding.
13.3 Class Action Waiver
You agree to resolve disputes with Ossia on an individual basis only. You waive any right to participate in a class action lawsuit or class-wide arbitration against Bobenhouse Industries, LLC.
13.4 Exceptions
Either party may seek injunctive or equitable relief in any court of competent jurisdiction for matters relating to intellectual property rights or unauthorized access to the services.
14. Changes to Terms
We may update these terms from time to time. Continued use of our services after changes constitutes acceptance of the new terms. We will notify you of material changes through the platform or via email at least 15 days before they take effect. If you do not agree with updated terms, you may cancel your subscription before the changes take effect.
15. Force Majeure
Ossia shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from events beyond our reasonable control, including but not limited to natural disasters, acts of government, network or infrastructure outages, third-party service provider failures, labor disputes, or cyberattacks. During such events, our obligations under these Terms are suspended for the duration of the force majeure event.
16. Governing Law
These terms are governed by the laws of the State of Illinois, United States, without regard to conflict of law principles. Subject to Section 13, any disputes not subject to arbitration shall be resolved in the courts located in Cook County, Illinois.
17. Severability
If any provision of these Terms is held to be unenforceable or invalid, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
18. Entire Agreement
These Terms, together with the Privacy Policy and any statements of work or order forms, constitute the entire agreement between you and Bobenhouse Industries, LLC regarding your use of the services. These Terms supersede any prior agreements or understandings, whether written or oral.
